Terms and Conditions of Membership

Welcome to Borrow it and our Borrowing Agreement. To make sure you understand our service please read and sign this document prior to borrowing items and make sure you agree to the terms in our waiver before you consent.

Borrowing Agreement

1.       Membership will only be granted to people 18 years old or over

 2.       To the satisfaction of Borrow It, membership will only be granted to applicants who a) agree to the terms of the borrower agreement (this document) and our other terms and conditions (e.g. charges and fees) b) provide photo proof of ID c) provide proof of address and d) register a payment card (where a payment is required). 

 3.       Personal data will be held in accordance with current UK legislation.

 4.       By borrowing an item the member certifies to Borrow It that they are capable of using that item in a safe and proper manor.

 5.       Only the Borrower may use the tools lent to them, unless with express permission of Borrow It.

 6.       All items borrowed must be returned before the specified time on their due date

 7.       Borrowers are responsible for paying all fees connecting with the loan of things including fees and costs if things are returned a) late b) dirty or unclean c) damaged up to the cost of replacing the item plus reasonable administrative costs.

8.       Borrow It reserves the right to use appropriate steps to retrieve tools or unpaid fines and fees, including the use of legal actions and charge the member the full costs of such action, plus reasonable administrative costs. Borrow It reserves the right to forgive, suspend or collect fees in full or part its discretion. 

 9.       All parts of any item(s) must be returned to Borrow It for the whole of the item(s) to be deemed to be returned. For example, don’t return the drill without the battery!  Any thefts must be reported as soon as possible to Borrow It, and the items are deemed as remain in the possession of the member until such time as they are reported or recovered.

10.   Reserving an item does not mean that it will be available to be borrowed at the time of collection, and Borrow It can not accept any costs associated with losses that this causes – other members may be late returning things or require fixing. Also, Borrow It can’t be held responsible for any losses, expense or inconvenience that this causes.

 11.   If any item becomes unsafe, the member must immediately discontinue the use of the tool and notify Borrow It of the issue and return the item as soon as possible. The borrower can only use the tool for the purpose intended

12.   Normal wear and tear accepted, the member agrees to pay for the loss of, or damage to, any item and agrees to accept Borrow It assessment of condition of items, acting reasonably. The member agrees to the assessment by Borrow It of fair restitution for damage, delinquency and/or loss or items in part or in total. This restitution could equal the full replacement cost of the item, plus reasonable administrative fees.

13.   All items must be returned cleaned and in the packaging provided, with any ancillary documentation, handbooks or guidance notes etc. The member agrees to pay any repair or cleaning fees or charges deemed to be necessary by Borrow It acting reasonably.

14.   Borrow It reserves the right to refuse any loans of any items at its discretion

15.   Members unsure how to operate any item or feel they need training, must make arrangements with Borrow It for training and/or a demonstration prior to using the item they have borrowed.

16.   Membership and any borrowing rights can be terminated at any time at the sole discretion of TIC, and will be withdrawn in cases of late returns, abuse, harassment, non-payment of fees, malicious damage, abuse of 'fair use' ethos, and, health and safety

17.   Items can be borrowed for personal, social and domestic use only. You can not use the items commercially or for your work. 

18.   At the discretion of Borrow It some items may be lent with supplementary items. Where items are lent in sets or with supplementary items, the loss or damage to any part may mean the costs of the whole may be due. E.g a specific charger, maintenance tool etc

19.   We do not guarantee provide consumables, e.g. sanding pads, drill bits, screws etc. Where these are provided, Borrow It does not accept any liability resulting from their quality. These items are sometimes donated and in no way is providing them an endorsement of their quality or suitability.  

20.   Any monthly fee paid is a membership subscription to be a member of Borrow It. This doesn’t constitute a payment to borrow any particular item at any specific time. Items may be withdrawn from the stock of things you can borrow at any time for good reasons.  

21. Membership is at the discretion of Borrow It, who will not discriminate membership on the grounds of protected characteristics, but may refuse or cancel membership for 1. attempting to get free membership when not eligible for free membership 2. living in an area that we can not service, typically 20 mins from any collection point, or outside the borough for which the  services has been funded, 3. late return of items 4. fees that are not paid when payments are due 5. being abusive or inconsiderate to volunteers and staff, and other grounds while acting reasonably.   

22. To end your membership you must complete the leaving form. Any items that has been borrowed must be returned and and any fees or charges must be paid. Should you wish to re-join Borrow It as a member, Borrow It may ask for a rejoining fee to prevent stop-start membership.   

23 A condition of free membership is that you consent to use sending you offers and publicity information from time to time, to further our charitable aims and mission

Liability Waiver

Borrowers must also agree to the following statements:

  • I state that I am capable of using the items I am borrowing, knowing how to use them, and that I will use the items am borrowing in a proper manner.
  • I state that I will use whatever protective equipment is appropriate for the items I am borrowing.
  • I do hereby for myself, on behalf of my successors and assigns, in consideration of being permitted to borrow tools, waive any and all claims against Borrow It, its Trustees, employees and volunteers for any injury or injuries of any nature that I may suffer or incur in the use of the tools that I am borrowing from Borrow It.
  • I hereby for myself, on behalf of my successors and assigns, in consideration of being permitted to borrow items, agree to release and indemnify and hold harmless Borrow It, its trustees, employees and volunteers any and all liability, loss, claims, and demands, actions or causes of action for the death or injury to any persons and for any property damage suffered or incurred by any person which arises or may arise or be occasioned in any way from the use of items I am borrowing from Borrow It.
  • I am aware Borrow It, its partners, directors, employees, members, and volunteers claim no expertise and make no representation concerning the fitness of any tool for any particular use.
  • I affirm that any membership information provided to Borrow It is current, true and correct and consent to any verification deemed necessary.
